State Application of Specific Laws

 

 

Although the complete body of intestate laws followed by each state are different, there are individual aspects of the law that are shared among the states.

 

Begin by selecting a topic from the main menu below, then choose a radio button from the options that appear within the main screen.  The radio button that you select will complete a sentence that describes an area of intestacy law.  Once chosen, the states that apply the law described by your selection are listed in the box below.

 

This unique summary allows you to determine the similarities between states, as well as discovering whether your state of interest applies any individual aspect of the law.

As an example, choosing "Spouse as Parent" from the main menu reveals four phrases associated with "The surviving spouse receives less of the intestate estate if:"

 

Selecting the radio button beside the phrase "any of the deceased spouse's children are minors" results in "Colorado and Maryland" being shown in the answer box.

 

This means that Colorado and Maryland are the only states in which "The surviving spouse receives less of the intestate estate if any of the deceased spouse's children are minors."
